What are the penalties for conducting business without applying for a commercial performance license?

If a commercial performance is held without approval, the cultural administrative department of the people's government at the county level shall order it to stop the performance, confiscate the illegal income, and impose a fine of not less than 8 times but not more than 10 times the illegal income; there is no illegal income or the illegal income is less than 10,000 yuan. If the amount is more than RMB 50,000, a fine of not less than RMB 50,000 but not more than RMB 100,000 shall be imposed; if the circumstances are serious, the original license-issuing authority shall revoke the commercial performance license.

Conditions for commercial performance licenses

(1) There must be a performance agent in the business scope
(2) Additional conditions must be added to the exclusion of foreign investment from Hong Kong, Macao and Taiwan
(3) Physical office address (no verification is required, it is best not to provide the registered address of the concentration area)
(4) There are more than 3 full-time performance brokers (performance broker qualification certificate).

Notes on applying for a commercial performance license

(1) Domestic capital shall be handled at the Cultural Bureau where the company is registered;
(2) For Sino-foreign joint ventures, the Chinese party must account for more than 51%, and the local Cultural Bureau shall report to the Ministry of Culture for approval;
(3) The company can apply for approval for foreigners to perform in China only if the company has more than two years of performance experience;
(4) Artists can be signed only after the company has obtained the performance brokerage license

(1) The pre-approval notice for the name of the performance brokerage agency or the original copy of the business license and the copy with the official seal;
(2) Resume, email, landline, mobile phone, and zip code of the legal representative;
(3) Identity certificates of the legal representative and the person in charge (copy of ID card, copy of passport);
(4) A copy of the proof of the right to use the residence (including the title certificate and copy of the lease contract);
(5) Qualification certificates of more than 3 full-time performance brokers (performance broker qualification certificates issued by China Performance Industry Association) originals, copies and copies of ID cards;
(6) Capital certificate (original capital verification report or capital entry form, etc.) (copy with company seal);
(7) A copy of the original account opening license (the copy shall be stamped with the company's official seal);
